As I enter my fourth year as an independent arbitrator and counsel, I would like to thank ADR Chambers for the support it has provided throughout my transition from being a partner in a major Canadian law firm to my current practice.  In one sense, our association has succeeded too well.  In order to support the level of professional activity that has developed in my work both as an arbitrator and as counsel, as well as my desire to set my own goals and standards, it has proven necessary for me to duplicate on a personal basis most of the resources which ADR Chambers provides, on a shared basis, to its members.  We have had to confront the reality that what has evolved are two separate professional enterprises.

On January 18, 2010, I begin practicing from my new premises at 141 Adelaide Street West, Toronto, M5H 3L5.  My new offices are in space that is shared with other (more distinguished) arbitrators and a leading court reporting service which will be able to provide conveniently located, up-to-date hearing rooms and all necessary services.

For those who are not familiar with my practice, my services are provided in two categories: work as a neutral and work as counsel:

Neutral Work

I act as arbitrator or mediator in commercial and complex disputes, in all institutional and ad hoc settings.  I should be contacted directly for neutral assignments.  When I am contacted to discuss the possibility of my serving as the chair of a tribunal, sole arbitrator or mediator it is my strong preference to be contacted by counsel for all parties (or by party appointed tribunal members) at the same time, or that the person who contacts me indicate that he or she is doing so with the permission of the other parties.  When I am being contacted to serve as a tribunal member, it is critical that there be no discussion of the merits of the case even if the appointment would be as the nominee of a party to the dispute.  

Counsel Work

My counsel work is done:

i. in collaboration with law firms or other specialists, on a case by case basis, where that is required, or

ii. independently, in assignments where little or no support is required (e.g. second opinions or limited retainers).
